Why are the Madison County Commissioners considering taking control of the Board of Health?

MARSHALL – The Madison County commissioners are seeking a takeover of the county health department.
In the Madison County Board of Commissioners’ May 13 meeting, the commissioners voted to advance the idea of the commissioners assuming control of the Board of Health.
According to county attorney Donny Laws, North Carolina General Statute 153A-77 allows county commissioner boards to gain control over boards, agencies and commissions, such as a county Board of Health. The statute reads, “the board of county commissioners may assume direct control of any activities theretofore conducted by or through any commission, board or agency by the adoption of a resolution assuming and conferring upon the board of county commissioners all powers, responsibilities and duties of any such commission, board or agency.”
Laws said the statute was introduced In 2012.
The Madison County Board of Health is comprised of 11 members, including various health care professionals, including a physician, a dentist, registered nurses, a veterinarian and a pharmacist, as well as Madison County Board of Commissioners Vice Chair Jeremy Hensley.
Chair Matt Wechtel also previously served on the Board of Health.
As far as Laws could tell, the county has operated under the current format with the board of health for roughly 50 years.
According to the board attorney, the statute would allow the commissioners to abolish the existing Board of Health and assume direct control over the Board of Health. Next steps:
The commissioners voted to adopt the resolution to hold a public hearing to hold a vote on assuming some sort of control over the Board of Health.
Per the statute, an advance notice of at least 30 days must be provided before the public hearing.
“This will give people in the community the opportunity to express their wishes, their desires, either for the takeover or not,” Laws said. “After you hold the public hearing, only then can you actually adopt the resolution formally abolishing the board.

For Hensley, the Madison County Board of Commissioners vice chair, one of his main concerns was liability.
“As a citizen, if I had trouble with the department, I would want to call an elected official instead of a board member who’s not elected,” Hensley said. “We get those phone calls anyway. But we’re just passing the buck.
“As a commissioner board, I think we need to have the legal liability to what affects our county.”
Hensley wondered whether, under the current format, if the county would be held liable if a suit was brought against the Board of Health.
According to the Laws, the answer is yes.
The board attorney pointed to an example from 2022 where a county resident sued Madison County, the Madison County Health Department and the Madison County Board of Health after “an environmental health issue” in which the resident “through they were wronged.”
“If that same thing happened, you still have a health department, so you could have a lawsuit filed against the health department,” Laws said. “They sued the health department. If a lawsuit comes up, it’s probably going to be the same thing.”
As it exists now, the Madison County Board of Health are state personnel employees, as are the Department of Social Services employees, and a number of Madison County Sheriff’s Office employees.
Madison County’s current health director is Tammy Cody.
“All of our operations at the health department are running well,” said Cody. “We have no financial concerns and continue to pass all of our audits. None of our programs have corrective action plans. I am truly blessed to work with a dedicated board and staff who love our communities and want the best for all of our residents.”
“Your health director basically governs the health department,” Laws said. “Right now, you sitting as a board, you all don’t have any … there’s nothing you can do about it.
“People can say to you all whatever they want to say about the Board of Health, but you have no control in any form or fashion. You have no responsibility, except for, if there is any liability, the county pays for it.”
In Laws’ view, if the county commissioners “want to be a board that does not delegate to other people, but wants to assume more of a direct control, then that’s what this statute allows you to do.”
Hensley and Laws felt assuming control of the county Board of Health would “put more accountability on the health department.”
“Your health director would be answering to you, instead of to a Board of Health,” Laws said.
“The statute allows you to be more directly involved with what goes on in your health department.”

Donny Laws is an idiot and self-serving and should have been fired years ago and sent back to Yancey County, where this hayseed belongs.
Do you think these commissioners will be able to manage the Health Department after they have wasted our tax dollars, drained the fund balance, and illegally mismanaged money from Federal Grants?

Only four counties out of one hundred in this state have chosen to take over the duties of their health board. This sounds like another Madison County boondoggle, the Juvenile Detention Center, which has been shut down. Only two were in the state when Harwood wanted to do a juvenile detention center. There is a reason for that, and that is because they bleed the tax coffers. How is that working out for old Buddy currently? Maybe Hensley needs to educate himself before vomiting out his ignorance and putting Madison County in a position that will cost the taxpayers copious amounts of money and a takeover by the state.

Tammy Cody, whom I have called out in the past, is neither a liability nor is the Board of Health. Tammy Cody has cancer and still comes to work every day and works after hours to make sure the Madison County Health Department is operating legally and properly.
Madison County would operate more efficiently if it had more Tammy Codys on its payroll.

According to the county manager, he met with Southern Disaster Recovery Jan. 14, and it was estimated that each of the 274 waterway debris piles would cost roughly $100,000 to get approved for reimbursement, bringing the total to roughly $27.5 million.
“Buncombe County asked for $70 million, and got $34 million up front,” Honeycutt said.
Honeycutt emphasized that the county operating budget and the FEMA operating budgets are two separate accounts.
“You will see our budget grow during this timeframe. The impact to the budget itself that we operate on a day to day should not be impacted,” Honeycutt said.
While no projects have been submitted through the electronic portal to the federal government yet, the first project to be submitted will be the mobile courthouse .
“It’s a $3.2 million load into the portal, half up front, half at delivery, with a file of receipt,” Honeycutt said. “It’s a normal court, if you think about a normal courthouse, much like this building, with everything you’d want in a court – holding cells, clerk of court offices, the DA’s in there, sheriff’s offices.”
As of Jan. 14, the county had spent roughly $756,000 in labor during the Helene response, and an additional $200,000 elsewhere.
By the end of the month, those expenditures will jump an additional $1 million, Honeycutt said.
So why has Madison County spent tax dollars on things like the Fairgrounds instead?
Madison County Fairgrounds need repairs after Helene; plans for rodeo to return July 4

MARSHALL – The Madison County fairgrounds took a big hit in Tropical Storm Helene, and the county is working to repair the grounds.
The county is working with Providence Construction Group, County Manager Rod Honeycutt said in his March report to the county Board of Commissioners. According to Honeycutt, the Helene flooding created a slope in the rodeo arena. Additionally, the project manager with Providence Construction Group also stepped away from the project, which has only delayed progress further.
Providence Construction Group was also contracted to build the arena at Tryon International Equestrian Center and Resort in Polk County.
Honeycutt said the county manager’s office will bring the request for proposal before the board in a later meeting. The request for proposal breaks up the project in two phases.
According to the county manager, the first phase carries a target deadline of June 15 in order to allow for Madison County Championship Rodeo to return July 4.
Phase 2 will be from July 4 to late September, when the Madison County Fair typically takes place.
“We believe we will have all the construction done during that time frame,” Honeycutt said.
According to the Madison County Fairgrounds Facebook page, the covered arena is 300 feet long and 175 feet wide.
The new covered arena will be similar dimensions, Honeycutt said, with the length being the same, and the width being from 175 to 200 feet. The county manager said the commissioners could expect to see the contract come through procurement either later this month or in April.
“It’s going to depend on pricing when that contract comes back,” Honeycutt said. “We’re going to do our very best to make sure that we have the county fair and the Fourth of July. It might be a slimmed-up version. But we’re going to put it on.”
In the Sept. 27, 2024, post announcing the cancellation, the organization said the county fairgrounds had received funding for repairs to the arena, along with other improvements.
The 2024 Madison County Fair was scheduled for Sept. 27, but was canceled due to Helene.
Rod Honeycutt invested more time and taxpayer money in the Madison County Fairgrounds than in the county’s waterways. He squanders our tax dollars on a high-end company out of Tryon, NC, just like any Military bureaucrat.
Notice the names of the Agricultural Welfare recipients not being audited and compare them with the names of the fairground committee and its advertisers. They don’t pay their fair share of taxes, yet they are the first at the trough for handouts.
I have a solution since they are feeding off the Madison Trough, make them clean up and fix their fairground…
Look below at the director’s advertisers and cross-reference them. I noticed in the flyer for the Fairgrounds that Lisa Lisenbee, who goes by Wyatt now, finally got ole Slick Head to marry her. She was caught in a barn committing adultery, and caused his and her divorce. This is who we hand our tax revenue to, folks. Priceless.
Remember the Agricultural welfare recipients, and the commissioner’s taxes went down after the Donnie Laws—Diana Norton County tax reassessment debacle? But the rest of us who don’t ask for a handout got creamed by Madison County Tax Office malfeasance.

Now think about it: Around the same time, Honeycutt was crying on iHeart Radio in Asheville, claiming they had no money and had used up their fund balance. It was pathetic to listen to. At the same time, Honeycutt announced that Madison Rivers were open for tourists before the complete cleanup happened. These iHeart-parrots and Ingles Market gave Homer a Hero Award. Are you kidding me?
But that is iHeart Radio, the vestige where no talent dwells. These are radio people who are required to follow the company’s Zionist narrative. The same company behind taking down TikTok because more people were watching TikTok videos than relying on the fake news of iHeart. Look at the advertisers for iHeart, International Fellowship of Christians and Jews.
